By accessing our website and purchasing raffle tickets, you agree to abide by the following Terms of Service (“Terms”). Please read these Terms carefully, as they constitute a legally binding agreement between you and Spirit Wellness.

1. Acceptance of Terms

By using our website, purchasing raffle tickets, or participating in any of our services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our website or participate in our raffles.

2. Eligibility

• Age Requirement: Participants must be 18 years of age or older to purchase raffle tickets and participate in the raffle.

• Non-Transferable: Raffle tickets are non-transferable and cannot be resold. Tickets obtained through unauthorized means or resales will be void.

3. Raffle Details

Spirit Wellness is conducting an online raffle, where we are raffling vehicles as prizes. By purchasing a ticket, you agree to the following:

• Raffle License: Spirit Wellness complies with the South Dakota Charitable Gaming Laws, which allow nonprofits to conduct raffles without a license as long as 100% of net proceeds are used for charitable, civic, or educational purposes.

• Prize Information: The prize(s) offered will be clearly stated on the raffle ticket page on our website, including details about the vehicles, their approximate retail values, and any specific terms associated with them.

• Drawing Date: Raffle drawings will take place on the date specified on the ticket or event page. Spirit Wellness reserves the right to change the drawing date in the event of unforeseen circumstances. In such cases, updated information will be posted on our website.

4. Ticket Purchases and Payment Terms

• Ticket Purchase Limitations: Ticket purchases are subject to availability. Once all tickets have been sold, no further purchases will be allowed.

• Pricing and Payment: Raffle tickets are priced as indicated on our website. Payment must be made through our designated payment processor. Spirit Wellness does not store your payment information, as payments are processed securely by third-party payment providers.

• All Sales Final: All ticket sales are final. No refunds will be issued except in the case of raffle cancellation. In the event of cancellation, ticket purchasers will be notified, and refunds will be provided within 30 days.

5. Winner Notification and Prize Conditions

• Winner Notification: A live draw will be made. In addition, winner(s) will be notified by email and/or phone within [7-10 business days] following the drawing. It is the responsibility of the ticket purchaser to provide accurate contact information. Spirit Wellness is not responsible for any failure to contact a winner due to incorrect or outdated information.

• Claiming Prizes: Winners must claim their prizes within 30 days of notification. If a winner fails to claim their prize within this timeframe, Spirit Wellness reserves the right to forfeit the prize and draw an alternate winner.

• Taxes and Fees: Winners are solely responsible for any federal, state, or local taxes, fees, or other expenses associated with claiming and owning the prize. For prizes valued at $600 or more, winners must complete an IRS Form W-9 and may be issued a Form W-2G for tax reporting purposes.

• Transfer of Ownership: Vehicle winners are responsible for all transfer, title, registration fees, and any other costs associated with the ownership of the vehicle. Prizes are awarded “as is” with no warranties or guarantees, either express or implied.

6. Use of Website

• Prohibited Conduct: You agree not to engage in any of the following prohibited activities:

• Using the website in a way that violates any applicable local, state, national, or international law.

• Attempting to gain unauthorized access to the website, servers, or networks.

• Intellectual Property: All content on our website, including text, graphics, images, and logos, is owned by or licensed to Spirit Wellness. Unauthorized use, reproduction, or distribution of our content is strictly prohibited.

7. Disclaimers and Limitation of Liability

• No Warranty: Spirit Wellness makes no warranties or representations, express or implied, about the accuracy, completeness, or reliability of the information on our website. All information is provided “as is.”

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Sioux Falls, South Dakota for the resolution of any disputes arising out of or related to these Terms.
